ABOUT US

Fancy Dress and Party Limited is registered within the UK under company number 09806764. Any usage of “us” and “we” in this policy refers to Fancy Dress and Party Limited. Any reference to “you” or “your” refers to the customer, whether public, trade or affiliate.

We are a VAT registered company - VAT Registration Number 411264636

Our trading address is 25-27 Meadow Street, Weston super Mare, North Somerset, BS23 1QQ.

ORDERS

Any acknowledgement of order, whether by electronic or verbal means does constitute acceptance of your order. The contract between us and you to supply the goods ordered is only executed when we dispatch your order. We reserve the right to cancel orders prior to dispatch for any reason. Once a contract to supply goods has been accepted, we are under a legal duty to supply goods that are in conformity with the contract.

Stock availability is not guaranteed until your order is accepted and dispatched. Display of an item on this website does not guarantee that the item is in stock and ready for dispatch. If any ordered items are out of stock we will not dispatch the remainder of your order without your consent.

Your order may be dispatched in separate consignments where operationally required and each consignment shall be treated as individual and unconnected orders. We will endeavour to contact you should dispatching your order in multiple consignments be necessary.

Any special requests must be agreed in writing before dispatching an order.

All prices on this website include Value Added Tax (VAT). We can supply VAT invoices on request.

YOUR CANCELLATION RIGHTS

All customers have a right to cancel their orders under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 calendar days from the date of receipt of any goods. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us, Fancy Dress and Party, 25-27 Meadow Street, Weston Super Mare, North Somerset, 01934 416375 of your decision to cancel this contract by a clear written statement (e.g. a letter sent by post or e-mail).Any customers exercising these rights shall be required to return the goods to us at our contact address at their expense within 14 days of requesting cancellation.

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

Please note, hygiene goods such as wigs, makeup, facial hair, underwear, hosiery, face paint and items designed to be used within any body orifice or on the face are excluded from the right to cancel once unsealed from their original packaging.

DELIVERY

We aim to dispatch all orders received before 2pm Monday – Friday except where closed through public holidays or advertised business closures. Some of our items are stored in a satellite warehouse and require 1 -2 additional business days to dispatch. Should this be the case we will clearly state this within the product description. Orders made before 2pm UK business days on items stored within the satellite warehouse will be dispatched the following business day. Items made after 2pm or on weekends / public holidays will be dispatched within two business days.

Delivery is priced at £2.99 as standard for Royal Mail 48, and £3.99 for Royal Mail 24. Delivery is fully insured and is sent through Royal Mail. The delivery aims of the courier are within two to four business days from dispatch for Royal Mail 48, and one to two business days for Royal Mail 24. This is not a guaranteed service and on rare occasions items can take longer to arrive. This is not a tracked service and only proof of delivery is obtained. We are required by Royal Mail to allow 14 business days before we can declare an item as lost and therefore refund for lost items.

Royal Mail Special Delivery guarantees delivery before 1pm the following business day after posting. This is a fully tracked, ‘signed for’ service. Tracking numbers are only provided on request. Please note, certain regions of Scotland are only guaranteed to arrive by 5:30pm the following day. Delivery to Herm, Sark, Lewis, Colonsay, Coll & the Shetland Islands are guaranteed to arrive within two business days of posting. Orders over 2kg in weight may be sent via an alternative courier. Where this is the case we will endeavour to contact you.

International orders are sent by Royal Mail. The delivery aim of this service is 5-7 days within Europe and 7-12 days to the rest of the world. This is a fully insured delivery service. A signature is required on delivery. Orders over 2kg in weight will either be shipped in separate consignments or via an alternative international courier service. We will endeavour to contact you should this be necessary. Should an item fail to arrive within these deadline we will ask the courier to investigate the loss. We cannot refund for lost international items until 21 business days have passed.

By submitting your order you are confirming that any address details provided are correct and you agree to arrange for the receipt of your goods. If an incorrect address is provided please contact us immediately via 01934 416375 as soon as possible as once dispatched goods are outside of our control. We cannot be held responsible for any items lost in such a manner. If a request is made to repost the goods returned to us following non-delivery additional payment for postage and packaging is required.

We reserve the right to charge any redelivery / failed delivery fees accrued which are the result of incorrectly supplied details or a failure to accept delivery of the goods.

Any estimates of transit time, whether displayed on this website or provided electronically or telephonically are not guaranteed. We cannot be held liable for orders delayed by the service of the postal service or any factors outside of our control. If your order arrives late you will be required to return the order subject to our returns policy below. Return postage costs in such situations shall be your responsibility.

International orders may be subjected to custom inspection and important fees and tax. Such fees are your responsibility. You are responsible for ensuring that all items within your shipment may lawfully enter your jurisdiction.

RETURNS POLICY

We operate a no quibble returns policy meaning you are welcome to return an item to us for any reason in the condition you received it in, subject to the terms below. We do not charge restocking fees or administration fees on our returns.

The cost of return postage (postage from you to us) will be your responsibility unless agreed in writing beforehand.

Items must be received by us in an “as new” saleable condition with all packaging intact and undamaged. This includes any header card or internal packaging. We are not a manufacturer and are unable to repack items returned to us in a poor condition.  Please ensure all items are protected from sources of smell such as cigarette smoke and perfume.

Items which show evidence of wear or deliberate damage will not be refunded. 

If we exercise any of our rights to refuse a refund you will have 28 business days to arrange collection of your item from our warehouse before the disposal of the item. If you require redelivery this will be via a recorded service and will priced according to the weight of your shipment and any packaging costs. We may dispose of the item in any manner we see fit if you fail to arrange such collection.

Items such as wigs, makeup, facial hair, underwear, hosiery, face paint and items designed to be used within any body orifice or on the face can only be returned unopened and unused with any seals intact.

We cannot be held responsible for any items lost in the return post and as such recommend a 'signed for' returns service with sufficient compensation to cover the value of your item.

Refunds will be processed within two business days of receipt and any payment returned to the originating card or bank account within 7 business days. We cannot under any circumstance refund to alternative bank accounts.

If you require an exchange this cannot be dispatched until receipt and process of your return. If an exchange is urgent, we recommend making a separate purchase whilst awaiting an exchange.

Your statutory rights are not affected by our returns policy

FAULTY ITEMS

Should you receive a faulty or damaged item please contact us within 7 business days of receipt and we will arrange for either a replacement item to be sent or arrange for a return and refund.

Items that become faulty through usage or are reported faulty outside of our returns policy will be replaced with a like-for-like item.

COLLECTION

We offer a collection service for local customers on orders purchased through our website. Orders placed before 9am Mondays - Fridays will be available to collect after 2pm. Orders placed after 9am Mondays - Fridays will be available to collect after 3pm. Some of our items are housed in a satellite warehouse and require an additional business day before collection. Where this is the case we will state so in the product description.

Collection can only occur during business hours of Tuesday – Friday 10am – 5pm and Saturday 9am – 5pm. Should you need to collect your item urgently or outside of these hours please contact us to discuss your requirements.

Any collection must be accompanied by a form of identification as stipulated on our click and collect page. If this is not possible, please call us to discuss alternative identification methods.

PAYMENT

We only accept the payment methods listed on this site. We do not accept cheques or bank transfers under any circumstances. 

Upon receiving your order, we will validate your credit/debit card details before accepting your order. If your card is declined after acceptance of your order, we will contact you. If this is not possible, we will cancel your order.

We do not store credit card details, nor do we share customer details with any third parties.

Our website uses industry standard encryption and security systems. We cannot however be liable for any data interception by third parties through no fault of our own.

All prices listed on this website contain VAT where applicable. VAT receipts can be provided on request. 

The current price shown on the website is the price you will be charged unless confirmed by us in writing prior to submission of your order. 

Payment must be resubmitted for any orders subjected to charge back, whether via PayPal or a third party bank. Where this is not possible goods must be returned at your expense to us within 7 business days and must be received in their original saleable condition.

COMPLAINT POLICY

We work hard to provide the best possible service to our customers. If for any reason you are unhappy with the service or product received please contact us by either ringing 01934 416375 between the hours of 9am – 5pm Monday to Friday or using the contact us form on our website.

We aim to reply within 24 hours of receipt with either an update or a resolution. Should you be dissatisfied with the resolution, you have the right to request escalation to management. At this stage your complaint will be fully reviewed by a manager and a full response will be provided.

PROMOTIONS

From time to time, we will employ voucher-based discount incentives. Only one discount code may be used per order and we reserve the right to withdraw any discount code at any time. Discount codes or vouchers have no tangible value whatsoever.

ITEM DETAILS

Every effort has been made to provide full and accurate descriptions and photographs of our items. Because of the variation between individual computer displays exact colour reproduction cannot be guaranteed. Minor variations can occur between description and the received items. Any sizing information is an approximate guide only and we cannot guarantee any particular item will fit you. 

Images are for illustration purposes only and do not form part of the contact between us and you.

FACE PAINT / MAKE UP / HAIR SPRAYS

You are advised to test any face paint / make up / hair product on a small area of skin prior to general application. Please leave at least 24 hours between testing and general application to test for allergic reactions. Do not apply to damaged skin or if pre-existing skin conditions apply. Care should be taken to avoid the eyes and mouth. We cannot be held responsible for any allergic reaction arising from a user failing to follow these guides.

Any links to third party web sites are provided for your convenience and do not provide endorsement of their services or content. Any access to such third party websites is at your risk.

You may link directly to our website but may not use content or imagery without our express permission.

SAFETY INFORMATION

Many of our items contain small parts and plastic packaging. Under no circumstance should a child be allowed to play with the packaging. Unless specifically stated otherwise our items are designed for adult use and no liability can be taken for their usage with children. Adult supervision is required with all childrens costumes and accessories.

DISPUTES

We are based in England and as such this contact is governed by English law. As such, any claim or dispute arising out of this contract must be made within an English Court. 

PRIVACY

We take data security very seriously which is why we guarantee we will not use your data for a purpose other than you have given us permission or disclose / sell your data to third parties.

In order to fulfil your orders, we need certain details such as your address and telephone number. We also ask for your data of birth to allow us to verify your identity should we need to contact you about your order. The provided details will only be used to produce your order and they will not be used for any other purpose.

If you decide to create an account with us these details will be stored on our secure server to allow you to purchase items quicker and easier in the future. It is possible to purchase items from this site without creating an account.

Our secure checkout is provided by PayPal – we do not see any of your financial information during checkout. We do not store credit card details, nor do we share customer details with any 3rd parties. PayPal are one of the World’s largest online payment services and guarantee your data security.

If you sign up to our mailing list, we will only use your email address to send you offers and discounts we feel will be of use to you. You can opt out of this at any time by logging into your account at Fancy Dress and Party.com.
